Article 01
What are cookies?
Cookies are small text files that a website places on a user's device (computer, tablet or mobile phone) when they visit it. They are stored in the user's browser and sent back to the web server on subsequent visits, allowing the site to recognise the user and remember information about their session, preferences or browsing behaviour.
In addition to cookies as such, there are other similar storage and tracking technologies that work analogously, such as local storage, web beacons (tracking pixels), analytics scripts and device fingerprinting. For the purposes of this Policy, all such technologies are covered by the generic term "cookies".
Cookies serve many different purposes: some are essential for the website to function correctly; others help improve the user experience by remembering preferences; and others are used for statistical or analytical purposes to understand how users interact with the site.

Applicable legal framework
The use of cookies in Spain is primarily regulated by the following legislation:
- Article 22.2 of Law 34/2002 (LSSI-CE): requires that non-strictly-technical cookies require prior informed consent from the user, after receiving clear information about the purposes of the processing.
- Regulation (EU) 2016/679 (GDPR): sets out the principles and requirements applicable to the processing of personal data, including data collected through cookies (free, specific, informed and unambiguous consent; right to withdraw consent; etc.).
- Organic Law 3/2018 (LOPDGDD): the Spanish implementing legislation for the GDPR.
- AEPD Cookie Use Guide (updated July 2023): a non-binding interpretive document establishing best practices for cookie information and consent.
- Directive 2002/58/EC (ePrivacy) and its transposition into Spanish law: the European reference regulation on privacy in electronic communications.
Under this legislation, cookies that are not strictly necessary to provide a service expressly requested by the user require the user's prior, free, specific, informed and unambiguous consent, expressed through a clear affirmative action (Art. 4(11) GDPR).

Article 05
Third-party cookies
Pirate Sailor uses third-party services that may place their own cookies on the user's device. Such third parties act as independent data controllers of the data collected through their cookies and have their own privacy policies.
5.1 Google LLC โ Google Analytics 4 and Google Tag Manager
Pirate Sailor uses Google Analytics 4 to obtain traffic statistics and analyse user behaviour on the website in an aggregated and anonymous manner. Google Analytics 4 sets the cookies _ga, _ga_[ID] and _gid described in Article 4.
Google Tag Manager is used as a tag container to manage the implementation of analytics tools. Google Tag Manager itself does not set analytics cookies.

Google LLC is certified under the EU-U.S. Data Privacy Framework, covered by the European Commission Adequacy Decision of July 2023. For more information on international transfers, see Article 8 of this Policy and Pirate Sailor's Privacy Policy.
5.2 No advertising or social media cookies
Pirate Sailor does not use behavioural advertising cookies, retargeting, social media pixels (Facebook Pixel, LinkedIn Insight Tag, etc.) or any other tracking technology for advertising purposes. The social media icons on the site are simple external links and do not set third-party cookies.
Article 06
Consent management
6.1 Cookie banner
When first accessing the website, a cookie information banner is displayed, allowing the user to:
- Accept all cookies, including analytics.
- Reject all non-strictly-necessary cookies.
- Configure preferences by cookie category.
In accordance with the AEPD Guide (2023), merely scrolling the page or closing the banner will not be interpreted as consent. Consent is only considered given when the user performs a clear affirmative action (e.g. clicking "Accept all" or "Save preferences").
6.2 Consent records
Pirate Sailor stores a record of each user's consent, including: the date and time of consent, the version of the banner displayed and the preferences selected. This record is retained for 3 years for compliance demonstration purposes (accountability principle, Art. 5(2) GDPR).
6.3 Withdrawal of consent
The user may withdraw or modify their consent at any time, with the same ease as when they gave it, via:
- The cookie preferences panel accessible from the "Manage cookies" link in the footer.
- Their browser settings (see Article 7).
- The Google Analytics opt-out add-on at: tools.google.com/dlpage/gaoptout.
Withdrawal of consent does not affect the lawfulness of processing based on consent prior to withdrawal. Rejecting analytics cookies will not prevent the user from browsing the website, although some functionality may be limited.
6.4 Minors
Pirate Sailor's website is not directed at children under 14. In accordance with Article 8 of the GDPR and Article 7 of the LOPDGDD, consent for the use of cookies by children under 14 requires the consent of those with parental responsibility or legal guardianship.
Article 07
How to manage cookies from your browser
In addition to the site's preferences panel, users can manage, block or delete cookies directly from their browser settings. Below are links to instructions for the most common browsers:
7.1 Private / incognito browsing mode
Most browsers offer a private or incognito browsing mode in which cookies are automatically deleted when the window is closed. However, cookies remain functional during the active browsing session. Using private mode is not equivalent to rejecting or disabling cookies.
7.2 Additional control tools
Additional tools allow users to control third-party tracking at a general level, regardless of the website visited:

Article 08
International data transfers
The use of Google Analytics 4 involves the transfer of data to Google LLC (USA). This transfer is covered by the European Commission Adequacy Decision of 10 July 2023 on the EU-U.S. Data Privacy Framework, in which Google LLC participates as a certified organisation.
Google LLC's certification can be verified in the official Data Privacy Framework Registry.

Outside the case described above, Pirate Sailor carries out no other international transfers of personal data collected through cookies.
Article 09
Amendments and effective date
Pirate Sailor reserves the right to modify this Cookie Policy at any time to adapt it to regulatory or jurisprudential changes, updates to AEPD or European Data Protection Board (EDPB) guidelines, or changes in the analytics services or tools used.
When new cookies are added or existing ones are materially changed, users will be informed via the cookie banner, and new consent will be requested where required.
The updated Cookie Policy will always be available at https://piratesailor.com/en/cookies.html.
